Civil Law is the most important of the laws, from which all other laws are taken. In the absence of a text in the particular regulations, its provisions shall be taken, as in the lack of a text in the Law of Commerce and the Law of Commercial Companies. In addition, Civil Law identifies the individual and the legal person and determines the domicile.
The Civil Law also defines the difference between things and money, determines real estate and movables, and sets out the sources of commitment in the Law, namely the contract and unilateral action, harmful act, and beneficial act, and the Law and sets out the difference between the tort and contract liability. It also clarifies the means of implementation and has specified the standards. The legitimate action to protect the execution (such as guaranteeing the debtor’s money for execution and indirect money, the fictitious lawsuit, the policy lawsuit, and the right to withhold the obligation).
The Civil Transactions Law also clarifies the contracts and divides them into ownership contracts, usufruct contracts, work contracts, gharar contracts, and personal insurance contracts. It also regulates the right of ownership, mortgage, surety, and solidarity between debtors. Thus, the Civil Law complements all privacy laws devoid of the text.
